SHERBURNE – Joshua T. Story, 23, has been charged with second degree murder in the early Saturday morning shooting death of Kallin P. Richards, 24, of New Berlin.
The Chenango County Sheriff’s Office responded to the scene early Saturday morning in the Village of Sherburne at 33 Classic St., where Sherburne Meadows apartments are located. The shooting took place in the complex’s parking lot.
Mr. Richards was shot while sitting in the driver's seat of his 2000 Ford Explorer in the parking lot of the Sherburne Meadows Apartments. The Sheriff's Office received a 911 call at 2:40 a.m. reporting shots fired in the parking lot. Upon arrival, deputies discovered the deceased in his vehicle. The driver's side window was blown out and the vehicle had come to rest against a tree. "Our investigation revealed that a physical confrontation had occurred between the deceased and a resident of the apartment complex in the parking lot just prior to the shooting," said Sheriff Tom Loughren during Saturday afternoon's press conference.
Story, 23 of 33 Classic St., Sherburne was arraigned in the Town of Sherburne Court at 2 p.m. Saturday before Justice Jim Peptis and public defender John D. Cameron was assigned as his counsel. The felony complaint filed by the court included the defendant’s “oral admissions” as part of the evidence against him.
An autopsy of Mr. Richards conducted by Dr. James Terzian determined the cause of death to be a gunshot wound to the heart and liver.
Story was remanded to the County Jail and because he is charged with a class A felony, he will not be eligible for bail until he appears in County Court.
