NORWICH – A Sherburne man was sentenced on a lesser charge in Chenango County Court Monday, after his alleged victim spoke out on his behalf.

Twenty-six-year-old Lee Anthony Warner was originally charged with first-degree criminal sexual act, a class B felony, and second-degree assault, a class D felony, and was remanded to the Chenango County jail on $25,000 cash bail by the Sherburne Village Court following his Sept. 5 arrest.

In an agreed-upon disposition, Warner pleaded guilty to second degree attempted assault, a misdemeanor, on Dec. 4 and was sentenced yesterday to six months at the Chenango County Correctional Facility with five years probation. Public Defender Alan Gordon noted in court that the plea did not require his client to register as a sex offender.

“Just the general extended and alcohol conditions apply, get a job and stay out of trouble, you understand,” Gordon told his client in reference to his plea.
