NORWICH – The jury trial of the people versus David T. Spencer is set to resume today in Chenango County Court.

It is alleged that Spencer operated his vehicle while intoxicated on Feb. 23, 2013. Spencer’s charge is a class E felony.

The prosecution called three witnesses on Tuesday and rested its case after 4 p.m. First Assistant District Attorney Stephen M. Dunshee attempted to prove to the members of the jury – beyond a reasonable doubt – that Spencer was driving his vehicle in an intoxicated state, wrecked said vehicle, and was walking down Route 7 in Afton when he was stopped by a State Trooper.

The first witness to take the stand was a man who had spotted Spencer’s vehicle facing in the wrong direction on I-88. He said he offered Spencer a ride, and said he dropped him off near Route 7, where Spencer said he would then walk home. The witness said after dropping Spencer off, he called 911 to report the accident, and he said he thought Spencer may have been drunk.
