Seven Indicted In The Month Of February

NORWICH – A Chenango County grand jury convened earlier this week to determine indictments for the month of February, and seven were subsequently indicted.

It should be a reminder that all individuals mentioned are innocent until proven guilty in a court of law.

• Jared S. Quackenbush, 20, of North Norwich was indicted on one felony charge as well as two misdemeanor charges. Quackenbush was charged with sexual abuse in the first degree, a class D felony; forcible touching, a class A misdemeanor; and endangering the welfare of a child, a class A misdemeanor.

It is alleged that Quackenbush, on Dec. 28, 2015 while in the Town of North Norwich did subject a 15-year old girl to sexual contact by forcibly holding the said victim down while touching her. It is alleged that this was done for the purpose of Mr. Quackenbush' own sexual desire.

• Alexander G. Griffin, 27, of Binghamton was charged with criminal contempt in the first degree, a class E felony; and aggravated harassment in the second degree, a class A misdemeanor.

It is alleged that on Feb. 2, of 2016 while in Bainbridge that Griffin did violate an existing order of protection, that had just gone into effect the previous day, Feb. 1, 2016. Griffen allegedly violated that order of protection by calling the victim on the telephone and threatening to kill and dismember her body. These threats caused the victim to fear for her physical well-being.

• Freeman J. Deabay, 44, of Norwich was indicted on one felony charge with three additional misdemeanor charges. Deabay was charged with the unlawful manufacture of methamphetamine in the third degree, a class D felony; criminal possession of a controlled substance in the seventh degree, a class A misdemeanor; and two counts of endangering the welfare of a child, a class A misdemeanor.

It is alleged that on Dec. 21, 2015 in the City of Norwich on Division Street and while acting in concert with another individual, that Deabay allegedly did possess a 16 ounce plastic bottle with plastic tubing. This plastic bottle allegedly contained: hydriotic sulfuric acid, sodium hydroxide, ammonium nitrate and white gas, in order to unlawfully manufacture methamphetamine.

The child endangering charges stem from the fact that two children were allegedly present in the house and were subjected to toxic chemicals from the manufacture of the methamphetamine. At the time of the arrest on Dec. 21, 2015 the children were four years old and nine months old.

• Stephanie S. Vierkant, 35, of Norwich was indicted on one felony charge with three additional misdemeanor charges. Vierkant was charged with the unlawful manufacture of methamphetamine in the third degree, a class D felony; criminal possession of a controlled substance in the seventh degree, a class A misdemeanor; and two counts of endangering the welfare of a child, a class A misdemeanor.

• Matthew J. Walters, 35, of Cortland was indicted on one felony charge as well as one misdemeanor charge. Walters was charged with burglary in the third degree, a class C felony; and petit larceny, a class A misdemeanor.

It is alleged that Walters, while in the Town of Lincklaen on Dec. 26, 2015 and in concert with another did knowingly and unlawfully enter into a seasonal residence with intentions of committing a crime. Walters allegedly then did commit a crime by stealing a Rugar 10/22 rifle, pancake air compressor, hunting knives, a cordless drill, inverters, inverter batteries, pop-up blinds, a sawzall and other assorted hand tools from the residence.

• Blair D. Elderkin, 22, of Sidney was indicted on two felonies as well as three misdemeanor charges. Elderkin was charged with two counts of burglary in the second degree, a class C felony; and three counts of petit larceny, a class A misdemeanor.

It is alleged that Elderkin while in the Town of Guilford, on Dec. 25, 2015 did knowingly enter and remain unlawfully in a residence with the intent to commit a crime. A crime was committed when Elderkin allegedly stole a department store gift card, a ceramic John Deere buck with a handle, and approximately $800 in United States currency.

The second burglary count alleges that Elderkin, on the same date but a different residence, did steal several lottery tickets and a pair of pink and black ear buds.

The three counts of petit larceny allege that Elderkin stole $100 from a parked vehicle of another victim. Before he allegedly moved on to another parked vehicle to which Elderkin took a Gander Mountain Camo Jacket, Gander Mountain pink and white blanket, CB radio, a carburetor, RC car battery pack, machete, and approximately $20 in loose change. Elderkin then allegedly moved on to his final parked vehicle where he stole approximately $30 in loose change.

• Mark Ponterio, 51, of Pharsalia was indicted on one felony charge as well as one misdemeanor charge. Ponterio was charged with criminal possession of marijuana in the second degree, a class D felony; and criminal possession of a weapon in the fourth degree, a class A misdemeanor.

It is alleged that on Oct. 21, 2015 at around 6:30 p.m. that Ponterio was in possession of one or more preparations, compounds, mixtures, or substances containing marijuana. This marijuana that Ponterio allegedly possessed had an aggregate weight of 462 grams.

The criminal possession of a weapon charge alleges that at the same time and place, that Ponterio was illegally in possession of a Taurus 9mm handgun.
