Windsor man dead after stealing car, opening fire on trooper 28-year New York State Trooper Timothy S. Conklin's windshield after Nicholas P. Philhower opened fire on him on State Route 17 in the Town of Kirkwood on Monday.

KIRKWOOD – A New York State Trooper has been treated and released for minor injuries following a shootout that left a Windsor man, who was being pursued for stealing his mother's car, dead.

On Monday at approximately 6:09 p.m., New York State Police at Binghamton received a report that Nicholas P. Philhower, age 30, of Windsor had taken his mother's vehicle without permission. The mother requested he be located and arrested.

At approximately 6:20 p.m., 28-year Trooper Timothy S. Conklin observed the suspect vehicle traveling west on State Route 17 in the Town of Kirkwood.

Philhower took evasive action upon seeing the trooper, driving through the median at the intersection of Interstate 81 and then onto State Route 17 east bound, coming to a stop shortly after.

At that point, Philhower – armed with a military style semi-automatic rifle – immediately opened fire on Trooper Conklin through the rear window of the stolen vehicle.
